These Terms and Conditions (“Terms”) govern your access to and use of the website https://uslegacypublishers.com and the book writing, editing, design, formatting, marketing, and publishing services offered by US Legacy Publishers (“we,” “us,” or “our”). By using our website or engaging our services, you agree to these Terms.

1. About Our Services

US Legacy Publishers provides professional support for authors, including writing and ghostwriting, editing, cover design, interior formatting, publishing guidance, and promotional content services. Service details, timelines, and deliverables are confirmed in a proposal, order form, invoice, or written agreement for each project.

2. Eligibility

You must be at least 18 years old and able to enter a binding agreement to use our services. By submitting a request or placing an order, you confirm that the information you provide is accurate and complete.

3. Quotes, Orders, and Payments

  • Quotes and estimates are based on the information you provide and may change if project scope changes.
  • Work begins after the agreed payment or deposit is received, unless otherwise stated in writing.
  • Fees, payment schedules, and accepted payment methods will be outlined before work starts.
  • Late payments may pause production until the account is current.

4. Project Scope and Revisions

Each project includes the scope and revision rounds described in your agreement. Additional revisions, rush delivery, expanded word counts, new design directions, or services outside the original scope may require extra fees and adjusted timelines. You agree to provide timely feedback, approvals, and materials needed to complete the work.

5. Client Content and Responsibilities

You represent and warrant that:

  • You own or have the rights to the manuscript, images, ideas, and materials you provide.
  • Your content does not infringe any copyright, trademark, privacy, or other rights.
  • Your content is not unlawful, defamatory, or otherwise prohibited.

You remain responsible for the accuracy of facts, claims, permissions, and legal review of your manuscript where needed. We may decline or discontinue projects that violate these Terms or applicable law.

6. Intellectual Property

  • Until full payment is received, we retain rights in drafts, concepts, and deliverables created for the project.
  • After full payment, ownership of the agreed final deliverables transfers to you as stated in your project agreement, except for third-party materials, fonts, stock assets, tools, or templates that remain subject to their own licenses.
  • We may retain copies of project files for backup, quality, and legal purposes.
  • Portfolio or promotional use of your project requires your permission unless otherwise agreed in writing.

7. Publishing and Third-Party Platforms

If we assist with publishing, distribution, or marketing through third-party platforms, those platforms’ terms apply separately. We do not guarantee acceptance, rankings, sales, reviews, advertising results, or specific commercial outcomes. Platform fees, account ownership, and royalty arrangements remain your responsibility unless otherwise agreed.

8. Confidentiality

We treat your unpublished manuscripts and project materials as confidential and will not share them except with team members or contractors involved in delivering the service, or as required by law. You also agree not to disclose our proprietary methods, pricing structures, or internal materials without permission.

9. Cancellations and Refunds

Cancellation and refund terms depend on the project stage and your written agreement. Deposits and completed work are generally non-refundable. If a project is cancelled after work has begun, you may be responsible for fees covering work already performed, licensed assets, and administrative costs. Unused prepaid amounts for unfinished approved work may be credited or refunded only if expressly agreed in writing.

10. No Guarantees

Publishing involves creative and market variables outside our control. We do not guarantee bestseller status, sales volume, media coverage, awards, or reader response. Timelines are estimates and may shift based on feedback cycles, manuscript complexity, or third-party processes.

11. Limitation of Liability

To the fullest extent permitted by law, US Legacy Publishers is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost opportunities, or reputational harm. Our total liability for any claim related to the website or services will not exceed the amount you paid us for the specific service giving rise to the claim during the three months before the claim.

12. Indemnification

You agree to indemnify and hold harmless US Legacy Publishers and its team from claims, damages, losses, and expenses arising from your content, your misuse of the services, your breach of these Terms, or your violation of any third-party rights or laws.

13. Website Use

You may use this website for lawful purposes only. You must not attempt to disrupt the site, scrape content without permission, introduce malware, or misuse forms and contact channels. All website content, branding, and design remain our property unless otherwise noted.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms at any time. The “Last updated” date shows the latest revision. Continued use of the website or services after changes means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Austin, Texas, unless otherwise required by applicable law.
